Nothing in these terms excludes, restricts or replaces any right or remedy that cannot lawfully be excluded under applicable consumer protection law in your province or territory.
1. General
These terms apply when you use our website and shop with Ruby Mahone Bay. We currently accept delivery addresses in Canada outside Quebec. By using the website, you agree to these terms.
2. Eligibility
By using this website, you confirm that:
- You have reached the age of majority where you live, or
- You have the consent of a parent or guardian
You may not use the website or our products for unlawful, fraudulent or unauthorized purposes.
3. Formation of the Contract
A contract is formed when you receive an order confirmation from us by email. We may refuse or cancel an order before it has been accepted in cases of suspected fraud, pricing or listing errors, lack of stock availability, or breach of these terms. If we cancel an order after payment, the full amount paid for that order is refunded.
4. Cancellation
Under our voluntary order-cancellation process, orders may be cancelled within 12 hours of purchase, provided they have not entered processing. Once an order has been processed, packed, prepared for shipment or handed to a carrier, cancellation cannot be guaranteed. If the order has shipped, you may request a return after delivery under our Return and Cancellation Policy.
This section does not limit any separate cancellation right that applies under consumer protection law in your province or territory.
5. Product Information
We aim to present our products accurately. Colours may vary depending on screen settings, minor variations in texture or appearance may occur, and product availability and prices may change without notice. Nothing in this section limits mandatory rights concerning goods that are defective, incorrectly described or otherwise fail to meet a legal requirement.
6. Prices and Payment
All prices are shown in Canadian dollars (CAD) unless stated otherwise. Prices may change without notice. Payment must be made in full before an item is shipped. We use secure, encrypted payment systems. Ruby Mahone Bay does not store full card details.
7. Delivery
Estimated delivery times are guidance and are not guarantees. Delivery may be affected by carriers, weather, incorrect delivery details or circumstances beyond our reasonable control. Risk in the item passes on confirmed delivery, except where applicable law provides otherwise.
8. Returns and Refunds
Ruby Mahone Bay offers a voluntary 30-day return window from confirmed delivery, subject to the conditions in our Return and Cancellation Policy. For an ordinary voluntary change-of-mind return, you are responsible for return shipping. These voluntary terms do not limit any right or remedy that applies under consumer protection law in your province or territory.
9. Prohibited Use
You may not use the website for unlawful or fraudulent activity, to breach applicable law, to upload malicious code, to interfere with website security, or to abuse customer care. A breach may result in service being suspended or terminated.
10. Intellectual Property
All content on the website, including images, text, logos, graphics and product descriptions, belongs to Ruby Mahone Bay or its licensors. Unauthorized copying, reproduction or distribution is prohibited.
11. Website Disclaimer
We do not guarantee that the website will always be uninterrupted or error-free. This website disclaimer does not apply to, or reduce, mandatory guarantees or remedies concerning products or services.
12. Limitation of Liability
To the extent permitted by applicable law, Ruby Mahone Bay is not liable for indirect or consequential loss, loss of profit or revenue, temporary website interruptions, or unauthorized access that was not caused by our failure to meet an applicable legal duty.
Any limitation in these terms applies only to the extent permitted by law. Nothing in these terms limits liability, rights or remedies that cannot lawfully be limited.
13. Responsibility for Misuse
You are responsible for reasonably foreseeable loss caused by your unlawful misuse of the website or your material breach of these terms, to the extent permitted by applicable law.
14. Third-Party Services
Our website may use third-party services, including payment processors, analytics tools and shipping partners. Those services may have their own terms. Nothing in this section removes Ruby Mahone Bay's own obligations to you under applicable law.
